Corporate jet pilots Daniel Van Dyke and Richard Hannah were traveling westbound on I-94. A car ahead of Van Dyke’s lost control on the icy road and stopped in the middle of the highway. Van Dyke was able to safely stop behind the other vehicle, but then a tractor-trailer slammed into his car, killing both him and his passenger. Van Dyke leaves behind a wife, while Hannah is survived by a wife and two children.

What was the cause of the accident?

The Kenneth J. Allen Law Group filed a lawsuit against Celadon Trucking Services, Inc., the owner of the tractor-trailer involved in the accident. Our firm alleged that the driver of the truck, Earnest Johnson, operated the rig in a negligent and reckless fashion, driving too fast for the icy road conditions.

According to a device recovered from the accident scene, Johnson engaged the truck’s cruise control system and had it set at 65 mph. The device showed that Johnson hit his brakes only one second before impact – far too late to avoid an accident. As a result of the accident, Celadon established a policy that drivers would no longer be able to use cruise control on icy or wet roadways.

Both Johnson and Celadon were at fault for this tragedy. Not only did Johnson drive in an unreasonable manner and fail to exercise caution in icy conditions. Celadon was also held liable for encouraging Johnson to violate Federal Motor Carrier Safety Administration regulations. In addition, the company was found liable for allowing Johnson to drive a tractor-trailer with cruise control enabled while driving on icy roads.
