The incident occurred on U.S. Highway 12 near Michigan City, Indiana on April 17, 2014.

Who was involved in the accident?

Joshua Smiley and his wife, Tiffany, were hit by a commercial truck owned by Tru-Check, a subcontractor for Northern Indiana Public Service Company (NIPSCO), a provider of natural gas and electricity. Tru-Check performs meter readings for NIPSCO.

What was the cause of the accident?

The Smileys were riding their Harley-Davidson motorcycle on U.S. 12 when they arrived at an intersection. The couple proceeded through a green light and was hit by a Ford Ranger driven by a Tru-Check employee. A box truck in the left lane was obstructing the vision of the Tru-Check driver, who decided to make a blind left turn nonetheless. According to the accident report, the employee assumed there was no oncoming traffic and was unable to see the approaching motorcycle.
When the employee made the turn, the truck collided with the motorcycle. The impact of the collision ejected the Smileys. Joshua Smiley suffered severe internal injuries and his left leg was severed below the knee. Tiffany Smiley also suffered internal injuries and a crushed left leg. The accident report showed that Joshua Smiley was found 47 feet from the motorcycle, while Tiffany was found approximately 120 feet away.

While both eventually recovered enough from their injuries to return to their jobs (Joshua is a steelworker; Tiffany is a nurse), they will feel the effects of the injuries for the rest of their lives.

Who was at fault?

We believe the driver of the Tru-Check truck was at fault for this horrific accident, gambling on no oncoming traffic when attempting to make the left turn. However, we also believe the company shares the blame due to giving the employee much more work than reasonably could be finished during her shift.
